Terms of Service

By creating an account or using the ProStock platform at getprostock.ca, you agree to these Terms of Service ("Terms") and our Privacy Policy. These Terms form a binding agreement between you and ProStock Inc. ("ProStock", "we", "us").

If you are using ProStock on behalf of a business, you represent that you have authority to bind that business to these Terms.

ProStock provides AI-generated inventory intelligence, weekly Buy Plans, analytics, and benchmarking for golf pro shops and recreational retail facilities. The platform is offered on a subscription basis.

ProStock is a decision intelligence tool. We provide recommendations based on your data. All purchasing, ordering, and operational decisions remain entirely your responsibility. ProStock does not place orders or transact on your behalf.

3.1 Plans

ProStock is available on Starter and Pro annual or monthly plans. Pricing is listed at getprostock.ca/pricing. Prices are in USD unless otherwise stated.

3.2 Billing

Subscriptions are billed in advance. Annual plans are billed once per year. Monthly plans are billed each month. All payments are processed by Stripe.

3.3 Free Pilot Period

ProStock may offer a free pilot period at its discretion. No credit card is required during the pilot. At the end of the pilot period, continued use requires a paid subscription.

3.4 Refunds

Annual subscriptions are eligible for a full refund within 14 days of purchase if you have not generated more than 2 Buy Plans. Monthly subscriptions are non-refundable. To request a refund, email nicole@getprostock.ca.

3.5 Price Changes

We will give you at least 30 days notice before changing your subscription price. Price changes take effect at your next renewal date.

You own your data. By uploading data to ProStock, you grant us a limited license to process it for the purpose of providing the service — specifically, generating your Buy Plan and analytics.

We do not sell your data. We do not share your raw data with other customers. Anonymized, aggregated data may be used for network benchmarking as described in our Privacy Policy.

You are responsible for ensuring you have the right to upload any data you provide to ProStock.

You agree not to:

• Use ProStock for any unlawful purpose
• Attempt to reverse engineer, copy, or resell the platform
• Upload malicious files or attempt to compromise platform security
• Share your account credentials with unauthorized users
• Use automated tools to scrape or bulk-download platform data
• Misrepresent your facility type or size to obtain pricing you are not entitled to

ProStock owns all rights to the platform, algorithms, Buy Plan methodology, and interface design. Your subscription grants you a non-exclusive, non-transferable license to use the platform during the subscription period.

You retain full ownership of the data you upload. ProStock retains ownership of the Buy Plans and analytics generated from that data.

ProStock is provided "as is." We make no guarantee that the platform will be error-free, uninterrupted, or that Buy Plan recommendations will result in specific financial outcomes. Inventory decisions are yours to make — ProStock provides intelligence, not guarantees.

We are not liable for losses resulting from reliance on Buy Plan recommendations, data errors in your uploaded files, or platform downtime.

To the maximum extent permitted by law, ProStock's total liability to you for any claim arising from use of the platform is limited to the amount you paid us in the 3 months prior to the claim. We are not liable for indirect, incidental, or consequential damages.

9.1 By You

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. Your data remains accessible for 30 days after cancellation, then is permanently deleted.

9.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay, or if we determine your use poses a risk to other customers or the platform. We will give you reasonable notice except in cases of serious violation.

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes will be resolved in the courts of Ontario.

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after that date constitutes acceptance.
